California Law - Who Gets Custody?

The California courts favor joint legal and physical custody, except where there has been domestic violence.

The court will consider the health, safety and welfare of the child as top priority. In particular, if a parent has a history of abuse (to anyone in a family relationship) or drug or alcohol use, the law generally opposes that parent having custody. (If both parents are abusive, the court is back to square one.)

The court may appoint a specially-trained child custody evaluator.
