California Law - What Are The Grounds for Divorce The only grounds for divorce (called "dissolution" in California) are: a) Irreconcilable differences, which have caused the irremediable breakdown of the marriage; or b) Incurable insanity. Marriages may also be void or voidable, based on polygamy, incest, mental incapacity, consent to marriage obtained by fraud or force, and other relatively unusual situations. Also, there is a procedure for " Summary Dissolution " in simple divorce cases. Sec. 2201, 2210.
