California Law - Summary Dissolution

In a summary dissolution case, there is no court hearing. The court simply accepts the joint request of the parties, after the parties file their papers and wait six months.

In order to qualify for summary dissolution, the following must be true:

  • There must be no children.
  • The wife must not be pregnant.
  • The marriage must have lasted 5 years or less.
  • There must be no land ownership (or options to purchase land) and no leases of longer than one year.
  • Total debt (other than automobile debt) must not be more than $4,000 (adjusted for inflation).
  • Community property gross assets must be $25,000 (adjusted for inflation) or less.
  • The separate property of each party must be $25,000 (adjusted for inflation) or less.
  • The parties must have agreed on a property division.
  • There must be no spousal support.
  • The parties must accept that they will never be able to go into court about this divorce.
