How Should I Regard The Temporary Custody Order? Often, if the parties can not agree about who will have custody while the divorce case is ongoing, the parties will ask a judge to make a temporary decision. The way it works is this: Both parties and their lawyers appear before the judge, make brief presentations, and the judge makes a decision. It is very important to be aware that this first meeting with the judge (called a "hearing") is very important. If the case comes to trial later, before a different judge, that later judge is likely to respect the earlier decision, no matter how hastily it was made. Also, the judge at an actual trial is likely to respect the status quo, which will be determined by that brief hearing with the judge.
