What Happens -- What is the Legal Process?
The most important part of the legal process consists of the negotiation between
you and your spouse -- which is not part of the formal legal process at all.
Having said that,
click here for a step-by-step description of the formal legal process
, from
start to finish. (If you use a mediator, you can skip or condense
some of these steps.)
Despite what you may have seen on TV, very few cases actually have a trial. Most cases
are "settled," which means that you and your spouse (and lawyers and/or mediators) negotiate a
written agreement.
If you fail to reach agreement, a judge will decide at a trial. Again, despite what you may imagine,
you probably do
not
want a judge to decide your case.
