Negotiations

Negotiations are not a "formal" legal step.

However, they are the heart of the divorce process.

The most serious negotiations often take place after the discovery and before the hearing.

This is the stage at which both sides have all the financial and psychological information, and so they can negotiate an agreement.

The negotiations are conducted in the shadow of the hearing and trial. Each side knows that if it does not get something close to what it could expect at a reasonable trial, then it can always stop negotiating and go to trial.

As a result, in a hotly-negotiated divorce, if both sides have the same view of what a judge would do, then the settlement tends to reflect their assessment of what would happen in a trial.

Most divorces do not actually go to trial, though. Even bitter divorces are usually negotiated to an agreement.
