Does Fault Affect Spousal Support?

In many states, fault (that is, who had an affair, was emotionally abusive, or was an unfit parent) does not affect alimony at all.

Some states' laws specifically direct the court not to consider fault in awarding alimony. These states look purely to the economic factors.

But a substantial minority of states do permit the judge to look at the entire situation, including moral wrongdoing, in awarding alimony.

Please consult a legal authority in your state for details.
